(www.artnativ.com), mobile applications, and related services (collectively, the “Services”). 

By using the Services, you agree to the terms of this Privacy Policy.

When you create an account, use our Services, purchase or sell artwork, or contact us, you

(e.g., shipping, billing, or studio address).

• Verification information: Government-issued ID (for artist verification or tax 

compliance).

or payouts.

• Artist content: Profile photo, biography, portfolio content (e.g., artwork 

descriptions, images, videos).

• Communications: Messages, inquiries, or feedback sent to ArtNativ or other users 

(e.g., buyers or artists).

When you access or interact with the Services, we may collect:

• Technical data: IP address, browser type, device type, operating system, and unique 

device identifiers.

• Usage data: Pages visited, time spent, clicks, search queries, and interaction 

patterns.

• Location data: Approximate location based on IP address or device settings.

• Cookies and tracking technologies: Information collected via cookies, web beacons, 

or similar technologies (see Section 8).

• Payment processors (e.g., PayPal, Flutterwave, Stripe) for transaction processing.

• Logistics providers for shipping and fulfillment.

• Personalize content, such as recommending artworks or curating exhibitions based

facilitate transactions and communications.

o Cloud hosting, analytics, or marketing providers to improve the Services.

• Legal or Regulatory Authorities: When required by law, court order, or to protect 

ArtNativ’s rights (e.g., in response to a subpoena).

data may be transferred to a successor entity, subject to equivalent protections.

All third parties receiving your data are contractually obligated to protect it and use it only 

for the purposes specified by ArtNativ.

As a global platform based in Canada, your personal data may be stored or processed in 

countries outside your jurisdiction, such as Canada, the European Union, or the United 

States. We use industry-standard safeguards, such as Standard Contractual Clauses 

(SCCs) or equivalent mechanisms, to ensure your data is protected during international 

transfers in compliance with applicable laws (e.g., GDPR, PIPEDA).

All artworks, images, videos, and other content uploaded by artists to ArtNativ remain the 

intellectual property of the respective artist or rights holder. Unauthorized use, copying, 

reproduction, distribution, or modification of any artwork or content on the Services, 

including for commercial purposes, is strictly prohibited without the express written 

consent of the artist and ArtNativ.

Stern Warning: Any unauthorized reproduction, adaptation, or use of artworks (e.g., 

creating derivative works, printing, or using for AI training) violates intellectual property 

laws and ArtNativ’s Terms of Use. Violators may face account suspension, legal action, and 

liability for damages, including statutory damages under applicable copyright laws (e.g., 

the Canadian Copyright Act, U.S. DMCA). ArtNativ employs tools like image hashing to 

detect unauthorized use and will take swift action to protect artists’ rights.

If you believe your artwork has been misused, please contact legal@artnativ.art as 

outlined in our Terms of Use.

Depending on your jurisdiction (e.g., EU/EEA, UK, Canada, California), you may have the 

following rights regarding your personal data:

• Access: Request a copy of the data we hold about you.

• Correction: Update or correct inaccurate or incomplete data.

• Deletion: Request deletion of your data (“Right to be Forgotten”), subject to legal 

retention requirements.

• Restriction: Limit how we process your data in certain circumstances.

• Objection: Object to processing for marketing or other purposes.

• Data Portability: Request a transferable copy of your data.

• Withdraw Consent: Revoke consent for data processing where applicable.

exhibitions, or platform features. You may opt out of these at any time via the 

unsubscribe link or account settings.

10. Children’s Privacy

The Services are not intended for individuals under 13 years of age (or the equivalent age in 

your jurisdiction). We do not knowingly collect personal data from children without 

verifiable parental consent. If we learn that a child’s data has been collected, we will delete

We retain your personal data only as long as necessary to:

• Provide the Services (e.g., process transactions, manage accounts).

• Comply with legal or regulatory obligations (e.g., tax reporting, dispute resolution).

• Protect ArtNativ’s legitimate interests (e.g., fraud prevention).

For example, financial transaction data may be retained for up to 7 years to comply with tax

The Services may include links to third-party websites or services (e.g., payment 

processors, social media platforms). We are not responsible for the privacy practices or 

content of these third parties. Review their privacy policies before engaging with them.

We may update this Privacy Policy to reflect changes in our practices or legal 

requirements. We will notify you of significant changes by:

• Updating the “Last Updated” date at the top.
